Q. If I work on special days like November 1 and 2, how much pay will I get for an 8-hour work?
A. If worked on November 1 and 2, an employee is entitled to 130 percent of his daily rate for the first 8 hours, and to an additional 30 percent of hourly rate on the said day for work in excess of 8 hours.
If not worked, an employee is not entitled to any payment unless there is a favorable company policy, practice, or collective bargaining agreement granting payment for special days even if not worked.
If worked and falling on the employee’s rest day, the employee is entitled for the first 8 hours 150 percent of his/her regular daily rate
Q. Can an employer require an employee to work on a holiday?
A. Yes, in the event that there is a justifiable reason like urgent work to be done, but provided that an employee shall be paid with the corresponding holiday pay as stated above.
Special day refers to special non-working holidays like Ninoy Aquino Day, All Saint’s Day, Last Day of the Year.
